In accordance with data protection legislation, GDPR Regulation (EU) 2016/679 of the European Parliament and of the Council/LOPDGDD Organic Law 3/2018, of December 5, and Article 10 of Law 34/2002 on Information Society Services and Electronic Commerce (LSSI), the owner of this website and the data controller for the data processed through this website is Stark Future SL - with Tax Identification Number (NIF) B01736354 (hereinafter, the "Company", "we", or "our"), with registered office at Carrer Batan Nº 2, Sant Boi de Llobregat, Barcelona, 08830, email address dpo@starkfuture.com, registered in the Mercantile Registry of Barcelona. This privacy policy describes how we collect, use, and disclose information about users of the Company's website. www.starkfuture.com ("Website"), the electric motorcycles sold by the Company, along with any replacement parts, accessories, clothing, tools, or other related products ("Products"), and the mobile application embedded in the Company's electric motorcycles ("Platform"), as well as any related services, tools, and features (collectively, the "Services"). For the purposes of applicable data protection laws, we are the data controller. For the purposes of this Privacy Policy, "you" and "your" refer to you as a user of the Services.

Please read this Privacy Policy carefully. By using, accessing, or downloading any of the Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use, access, or download any of the Services.

1. COLLECTION AND USE OF DATA BY THE COMPANY

When you access or use the Services, we may collect certain categories of information about you from various sources. Some features of the Services may require you to directly enter certain information about yourself. You can choose not to provide this information, but doing so may prevent you from using or accessing these features.

Purpose: To create an account; to facilitate login to the Services and facilitate transactions on the Services to fulfill our contract with you; to communicate with you (i.e., via newsletters, text messages, email and responses to inquiries submitted by you) with your consent or in our legitimate business interests; ; comply with any applicable legal obligation.

Access to certain Services, such as the Sam virtual assistant, requires the user to first create an account through the registration form or by logging in with social networks (Google or Facebook). Creating an account involves the collection of the data indicated in this section and its processing in accordance with the purposes described herein.

b) Protected classifications (demographic data) in the creation of the User account according to section a)

Data to be collected

  • Date of birth - Nationality (opcional)
  • Preferred language : The language is automatically detected based on browser settings, operating system, or geographic IP address. However, users can manually change their preferred language at any time through the options available on the Platform or in the corresponding form. The sole purpose of processing this data is to improve the user experience by displaying content in the most appropriate language.

In addition to the foregoing, we may use any of the above information to comply with any applicable legal obligations, to enforce applicable terms of service, and to protect or defend the Services, our rights, and the rights of our users or others.

g) Sending commercial communications and newsletters

Data to be collected:

- Name

  • Email address

  • Language preferences (if applicable)

-Personal telephone and/or mobile number

  • Interaction with sent emails (e.g., opens or clicks)

Source of the data:

Contact form, forms for participation in activities organized by the Company (e.g., test rides, events, raffles, newsletters), electronic communications, registration on portals or specific marketing pages.

Purpose:

If you have given your explicit consent by ticking the corresponding box, we will use your personal data to send you commercial communications by electronic means (e.g., email, SMS, instant messaging), newsletters, satisfaction surveys, promotions, offers and other commercial content related to Stark Future SL, its products, services, events and activities.

This processing can be carried out even if you have not previously purchased a product or created a user account, the legal basis of which is the explicit consent of the interested party (art. 6.1.a GDPR and equivalent regulations applicable in other jurisdictions).

Recipients: Marketing service providers and email sending platforms (e.g., Mailchimp); SAM (Stark Future SL Chatbot); CRM platforms or similar used by Stark Future SL for managing marketing campaigns. The updated list of these providers is available upon request to dpo@starkfuture.com. Remarks:

By consenting to receive commercial communications through any of our forms, you agree to the processing described in this Privacy Policy. You may withdraw your consent at any time using the unsubscribe link included in all communications or by contacting dpo@starkfuture.com.

Withdrawal of consent will not affect the lawfulness of processing based on consent prior to its withdrawal.

This processing is independent of other processing legitimized by our contractual relationship or legitimate interest, such as those described in section e) above.

h) Data processing in the Whistleblowing Channel

Data to be collected:

  • Name and surname (only if the complainant decides not to remain anonymous) - Contact details (email, telephone - if provided) - Relationship with the Company (employee, former employee, external collaborator, candidate, supplier, third party, etc.) - Facts reported and documentation provided - Information of persons involved in the facts reported (when applicable) - Technical connection data (for example, IP address, device, date/time of access)

The complainant himself, through the Digital Reporting Channel Platform enabled by Stark Future SL:

Purpose:

  • To allow the receipt, management, investigation and resolution of internal complaints, anonymous or not, about conduct contrary to the Code of Ethics, internal policies, applicable regulations or any irregular or illegal behavior related to Stark Future SL.

  • Ensure compliance with current legislation on corporate integrity, regulatory compliance, crime prevention and whistleblower protection.

  • To protect the rights of whistleblowers and the parties involved, guaranteeing confidentiality, non-retaliation and fair handling of the case.

  • Prepare internal statistics and aggregate reports to improve the compliance and internal control system.

Recipients:

  • Authorized personnel from the compliance area or internal training function of Stark Future SL

  • External provider in charge of managing the Digital Complaints Platform, as the data processor.

  • Competent administrative, judicial or police authorities, if legally required or as a result of the internal investigation

Data retention:

Personal data will be retained only for the time necessary to decide whether to initiate an investigation into the reported events, and in any case, for a maximum period of three months from receipt of the complaint if no action is taken. Afterward, the data may be kept blocked to address potential legal liabilities.

Additional guarantees:

  • The complaint can be made anonymously.

  • In the event of non-anonymity, the confidentiality of the informant's identity, as well as that of any third party mentioned, will be guaranteed.

3. HOW THE COMPANY SHARES ITS INFORMATION

4. INTERNATIONAL DATA TRANSFERS

Personal information may be exported outside the jurisdiction in which you reside. In such circumstances, governments, courts, law enforcement agencies, or regulatory bodies in that country or countries may access your personal information under foreign laws. You should be aware that the privacy standards in those countries may be less stringent than those in the jurisdiction in which you reside. Please note that you are not obligated to provide us with your personal data, but if you choose not to, we may not be able to provide you with our services or your access to them may be limited.

For any data transfer outside the EEA or the UK, we will take appropriate measures and safeguards in accordance with the GDPR to ensure that the recipient adequately protects your personal information in accordance with this Privacy Policy. 6. USER-GENERATED CONTENT

Certain features of the Services may allow you to upload content (i.e., profile pictures, message boards, etc.) ("User-Generated Content" or "UGC"). We or others may store, display, reproduce, publish, or otherwise use the UGC, and may or may not attribute it to you. Others may also have access to the UGC and may have the ability to share it with third parties. If you choose to submit UGC to any public area of the Services, your UGC will be considered "public" and accessible to anyone, including the Company.

Please note that we do not control who will have access to the information you choose to make available to others, and we cannot guarantee that parties who have access to such information will respect your privacy or keep it secure. We are not responsible for the privacy or security of any information you make publicly available on features that allow the creation of Terms of Use (TUUs) or for what others do with the information you share with them on those platforms. Information you provide on public or semi-public sites, including information you share on third-party social media platforms (such as Facebook or Twitter), may also be viewed by other users of the Services and/or users of those third-party online platforms, without limitation as to their use by us or a third party. However, please be aware that despite our reasonable efforts, no security measure is perfect or impenetrable, and we cannot guarantee "perfect security." 10. USER RIGHTS

If you are located in the EEA or the United Kingdom, you have certain rights regarding your personal information:

  • WITHDRAWAL OF CONSENT: WHEN WE RELY ON CONSENT TO PROCESS YOUR PERSONAL INFORMATION, YOU HAVE THE RIGHT TO WITHDRAW THIS CONSENT AT ANY TIME BY EMAILING US AT DPO@STARKFUTURE.COM. THIS WILL NOT AFFECT THE LAWFULNESS OF PROCESSING BASED ON CONSENT BEFORE ITS WITHDRAWAL.

To exercise any of these rights, you can contact dpo@starkfuture.com. We will respond to requests to exercise these rights without undue delay and, at the latest, within one month (although this period may be extended by a further two months in certain circumstances). If there are reasonable doubts about your identity, you may be asked to provide additional information necessary for Stark Future SL to verify it and thus respond to your request.

If you believe that the Company has not processed your personal data in accordance with applicable regulations, you may file a complaint with the Spanish Data Protection Agency through the website www.aepd.es or with the competent supervisory authority for data protection in the country where you live or work or where you believe we have infringed data protection laws, as applicable.

11. PRIVACY RIGHTS IN CALIFORNIA

This section applies only to California residents. For purposes of this Section 10, "personal information" for California residents has the meaning given to it in the California Consumer Privacy Act ("CCPA"), but does not include information exempt from the scope of the CCPA.

We will not discriminate against you for exercising any of your rights under the CCPA or similar laws of other jurisdictions, as the case may be.

We may from time to time share certain "personal information" about you with third parties for those third parties' direct marketing purposes. 12. DATA RETENTION

The personal data provided will be kept for as long as necessary to fulfill the purposes for which it was collected, including, but not limited to, product data during the life of the motorcycle, data to the extent necessary to comply with our legal obligations, resolve disputes and enforce our terms and conditions, other applicable terms of service and our policies.

If your data is used for several purposes that require us to keep it for different periods, we will apply the longest retention period. In any case, we limit access to your data only to those people who need to use it to perform their duties.

After this time, we will proceed to delete them from our systems, without prejudice to the possibility of keeping them, limiting their processing to the exercise and defense of claims, under the terms provided by applicable legislation.

14. UPDATING THIS PRIVACY POLICY

We may modify this Privacy Policy from time to time, in which case we will update the "Last Revised" date at the top of this Privacy Policy. If we make material changes to how we use the information we collect, we will make reasonable efforts to notify you, for example, by sending an email to the last email address you provided to us or by posting a notice of such changes on the Services, as well as taking other actions as required by applicable law.
