Stark Future Referral Program: WOLFPACK PROGRAM
Terms and Conditions
1. Introduction to the Program
The Stark Future SL (together with its subsidiaries, affiliates, branches, controlled entities, or its permanent establishments, hereby referred to as “Stark” or “Stark Future”) WOLFPACK PROGRAM (“the Referral Program”) seeks to foster an active community of Stark electric motorbike owners and enthusiasts who want to share their experience and passion for sustainable mobility. Your voice and experience can ignite the spark of change in others and lead them to join our green odyssey.
The Referral Program is subject to these Terms and Conditions and may change at any time without notice.
2. Program Objectives
- Strengthen the Stark user community by sharing positive experiences.
- Incentivize and reward existing Stark motorbike owners for referring new customers.
- Offer potential customers the opportunity to experience and discover the Stark motorbike.
3. Referral Program Mechanics
Owners of Stark Varg motorcycles (“the Referrer”) acting as ambassadors are empowered to share their passion for Stark’s sustainable mobility by recommending their motorbike to friends, family, and acquaintances (“the Referee”). This referral process is facilitated through the Stark app, enhancing the Stark community's growth and engagement.
- Referral Initiation: Referrers can introduce the Stark Varg to potential new customers by using the dedicated section for the "Wolfpack Program" within the Stark app. Through the Referral Program, the Referrer can guide his or her Referees to enter their personal details (including name, address, phone number, and email address) directly into the app.
- Making the Purchase: To proceed with a purchase, the Referee must visit the Stark Future website and log in using the email address provided during their initial entry in the Referrer's app. This email acts as the crucial link confirming that the purchase is made as part of the Referral Program from the Referrer, ensuring both the Referrer and the Referee receive the agreed recognition and rewards. If a different email account is used by the Referee when registering to purchase the Stark Varg, the benefits of the Referral Program will not apply.
4. Program Rewards
- For Referrers: Referrers will receive up to €300 credit (or the equivalent in local currency as advertised on the Stark app) to redeem for spare parts at Stark after each referred purchase of a Stark motorcycle. This reward is aimed at enhancing the Referrer's engagement with Stark Future. The €300 credit (or the equivalent in local currency as advertised on the Stark app) is non-exchangeable and cannot be redeemed for cash or any monetary equivalent. The Referrer acknowledges and agrees that the €300 credit (or the equivalent in local currency as advertised on the Stark app) is not transferrable and holds no cash value outside of its use as a purchasing medium for Stark's Products.
- For Referees: Referees purchasing their first Stark motorcycle will receive titanium footpegs as a complimentary reward with their purchase.
5. Conditions of the Referral Program
- The Referral Program is effective from 05/01/2024, subject to potential extensions or modifications by Stark Future.
- The rewards for the Referrer and the Referee shall be accrued only if the Referee completes his/her purchase of a new Stark motorcycle within 180 days of the initial referral (i.e., first date that the Referrer provided the details of the Referee to Stark).
- Participation in the Referral Program indicates acceptance of these Terms and Conditions, which are subject to change. Participants, both Referrers and Referees, must be at least 18 years old to qualify for rewards.
- The €300 credit (or the equivalent in local currency as advertised on the Stark app) reward for Referrers is valid for 12 months from the issuance date of the credit (i.e., date that the Referee purchases a Stark motorcycle).
- Rewards are non-transferable and cannot be exchanged for cash.
- There is no limit to the number of referrals a Referrer can make annually.
- Referrers do not have any contractual relationship with Stark Future SL or its affiliates and are not authorized to represent or bind Stark. The Referrer shall participate in the Referral Program as an independent party. The Referrer is not and shall not be considered an agent, employee, or representative of Stark Future or any of its subsidiaries or affiliates.
- The Referrer lacks any authority to make commitments, promises, or agreements on behalf of Stark Future. No conduct or relationship in the context of the Referral Program shall be construed to establish any form of partnership, joint venture, or employer-employee relationship between the Referrer and Stark Future.
- The Referrer agrees to indemnify and hold harmless Stark Future from any claims, damages, liabilities, costs, or expenses arising from the Referrer's misrepresentation as an agent, employee, or representative of Stark Future.
- The Referrer expressly agrees not to represent themselves as an agent, employee, or legal representative of Stark Future under any circumstances. This prohibition includes, but is not limited to, issuing any warranty or representation concerning Stark Future products or policies.
- This program is established on the principles of good faith, and Stark Future anticipates that all participants will engage with the same level of integrity. The primary goal is to acknowledge and reward the loyalty of Stark customers who enthusiastically promote Stark products to their friends and family. Use of paid advertising, sales payments, or offering incentives for using referral links is not allowed. We will disregard any referral links associated with behaviour that does not comply with these Terms and Conditions.
- Stark Future reserves the right to deny rewards if it determines that participants are engaging in deceptive or counterproductive behaviour that undermines the purpose and spirit of the program. Additionally, the Referral Program is subject to closure or modification at any time. Should any rewards remain unredeemed after the program's conclusion due to circumstances outside Stark’s control, these credits or benefits may be subject to cancellation.
6. Data Protection
The program strictly adheres to Stark Future's data protection policies, ensuring the confidentiality and security of participants' personal information in accordance with applicable data protection regulations. Stark Future, in strict compliance with the principles of the General Data Protection Regulation (GDPR) of the European Union and other applicable data protection regulations, is committed to ensuring the maximum security and confidentiality of the personal data of participants (the Referrers and the Referees) in its Referral Program.
6.1. Collection and Processing of Personal Data
By joining the Stark Future Wolfpack Program, the Referee and the Referrer clearly and unequivocally authorizes Stark Future to collect, store, and process their personal data such as name, email address, telephone number, and any other information relevant for the effective implementation of the Referral Program.
The collected data will be used for marketing and commercial purposes. This includes sending promotions, special offers linked to Stark Future products, and the constant improvement of the customer experience through any means, including electronic, which may be of their interest regarding the products or services of Stark Future.
6.2. Informed Consent
The Referee confirms that his/her consent is the result of a free, informed, and specific decision. Stark Future commits to keeping the Referrer and Referee duly informed about any relevant matter that may influence the processing of their personal data.
6.3. Rights of the Data Subject
In accordance with the GDPR, Stark Future ensures and facilitates the exercise of the rights of access, rectification, deletion, limitation of processing, data portability, and objection by the Referrer and Referee at any time.
To exercise these rights, the Referrer and/or Referee must send an explicit request to customer.support@starkfuture.com indicating the right they wish to exercise along with a copy of their identity document or an equivalent document that proves their identity.
6.4. Security and Confidentiality
Stark Future will implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, protecting personal data against unauthorized access, alterations, or destruction, and ensuring their confidentiality, integrity, and availability.
6.5. Data Transfer Outside the EU
In accordance with the General Data Protection Regulation (GDPR) and the European Commission's Decision (EU) 2021/914 of 4 June 2021 on Standard Contractual Clauses for the transfer of personal data to third countries, Stark Future SL ("Stark Future") commits to the lawful international transfer of personal data outside of the European Union. This process will be conducted under strict adherence to these newly updated Standard Contractual Clauses, ensuring that data transferred to Stark Future’s subsidiaries—Stark Future USA LLC, Stark Future CA LTD, Stark Future AUS PTY LTD, and Stark Future NZ LIMITED—receive protection that is essentially equivalent to that guaranteed within the EU.
The Referee expressly consents to the international transfer of their personal data outside the EU, understanding that these transfers are necessary for the fulfilment of the purposes outlined by Stark Future and are conducted in compliance with legal obligations. This includes ensuring that each recipient provides sufficient guarantees to implement adequate technical and organizational measures in line with GDPR requirements to protect the rights of the data subjects.
The explicit consent encompasses acknowledgment that Stark Future will ensure all transferred data is protected under appropriate legal safeguards as mandated by the GDPR. The Referee's consent to these transfers is informed by clear communication about the purposes of such transfers and the rights available to them, including the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
6.6. Revocation of Consent and Data Retention
The Referee may revoke their consent at any time without affecting the legality of the processing carried out prior to such revocation.
Stark Future will retain personal data for strictly the necessary time to fulfil the purposes set out in this policy and in accordance with legal obligations.
7. Data Entry by Referrers
In instances where a Referrer of the Referral Program enters personal data on behalf of a Referee, the Referrer affirms that he/she has obtained explicit, informed, and unequivocal consent from the Referee to do so. This consent includes permission to process the Referee's personal data as described in provision 6 of these terms and conditions.
The Referrer agrees to provide evidence of such consent upon request by Stark Future or the Referee, ensuring that all data entered is accurate and up-to-date and is provided voluntarily by the Referee.
The Referrer agrees to indemnify and hold harmless Stark Future, its representatives, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including but not limited to legal fees) arising from any breach of the Referee’s rights as a data subject. This includes breaches resulting from the Referrer's failure to secure the requisite consent for data entry or any other misuse of the Referee's data. The Referrer's obligation to indemnify will survive the termination of their affiliation with the Stark Future Influencer Program.
Stark Future reserves the right to modify this Privacy and Data Protection Policy to adapt to legislative changes, case law, or commercial practices. Any modification will be communicated to the Referees via email to ensure timely and clear communication. Referees are encouraged to keep their email addresses up to date and to notify Stark Future of any changes to ensure they receive all communications.
8. Right to Deny Benefits
Stark Future reserves the right to deny benefits or disqualify participants from the "Stark Referrers" Referral Program if they act in bad faith or contravene the program's spirit.
